On May 13 the next session of the work of the consultation center on intellectual property for exporters was finished.
During the work of the consultation center two questions were asked.
The first question from the manufacturer of chocolate concerned the possibility of protecting the exclusive rights to the trademark registered in respect of goods in class 30 of the Nice Classification through the prosecution of the manufacturer of beer, whose goods fall under class 32 of the Nice Classification.
The lawyer received a comprehensive answer on how to get a unique chance to have a statutory claim against the manufacturer of beer from the owner of a widely recognized consumer brand without having the possibility to prosecute the manufacturer of heterogeneous products.
The second question concerned the possibility of registration of the trademark of the foreign producer of women's clothing in the name of the Belarusian dealer in our country, registered in the country of origin.
The manager of the company received a detailed answer about such possibility, provided that the international norm of the Paris Convention for the Protection of Industrial Property, concerning the terms of agency relationship between the owner of the trademark and his agent or representative, is complied with.
