A trade secret regime may be established in respect of information that constitutes trade secrets, which simultaneously fulfils the following requirements trade secrets, which at the same time fulfil the following requirements:

- are not generally known or easily accessible to third parties in the circles that normally deal with this kind of information; and  deal with this type of information;

- have commercially valuable to the owner of the information because it is not known to third parties;

- are not objects of exclusive rights to the results of intellectual activity;

- are not classified as state secrets in accordance with the established procedure.

It is not allowed to register as trademarks designations dominated by signs and (or) indications used to designate the purpose of services.

Legal protection of a trademark in the Russian Federation may be stopped early in respect of all goods or part of goods and services, for individualization of which the trademark is registered, due to non-use of the trademark continuously for any three years after its state registration

A fantasy word mark has much more grounds for registration as a trademark compared to a mark that misleads the consumer as to the producer of goods or services
