The Patent Law Treaty, adopted in Geneva on June 1, 2000 came into force in Belarus on October 21, 2016.

In this connection, the date of filing applications for patents for inventions, utility models, received by the National Center of Intellectual Property no earlier than October 21, 2016, will be established on the date of receipt of the following documents:

- application for grant of a patent for an invention, utility model;

  • - description of an invention, utility model;

  • - drawings, if the description refers to them.

If these documents are not presented simultaneously, the filing date of an application for a patent for an invention, utility model will be determined by the date of receipt of the last document.

The missing deadline for submitting a request for patent examination of an application for a patent for an invention that on October 21, 2016 was not expired, will be restored at the applicant's request on the conditions.

Reference:  The missed terms by an applicant, at his/her request may be restored by the National Center of Intellectual Property on conditions that the patent fee payment is carried out, and there are valid reasons for missing the applicable time limit. The renewal request may be filed by an applicant to the National Center of Intellectual Property within twelve months from the date of expiry of the missed deadline.
