VII International Forum "Intellectual Property - XXI Century" (Moscow, April 21-25, 2014)
The representative of UP "BELPATENTSERVICE" of BelTPP the patent attorney Vyacheslav Trofimov took part in the VII International Forum "Intellectual Property - XXI Century" (Moscow, April 23, 2014).
The Forum, which included the Congress on Intellectual Property "EXPROPRIORITY '2014" and a number of international scientific and practical conferences, information and methodological seminars, round tables and sections, was held at various venues. The forum was timed to coincide with the World Intellectual Property Day and was organized by the World Intellectual Property Organization (WIPO), the Chamber of Commerce and Industry of the Russian Federation and ZAO “Expocenter”.
Co-organizers of the forum were the Federation Council and the State Duma of the Federal Assembly of the Russian Federation, the Ministry of Education and Science of the Russian Federation, the Ministry of Culture of the Russian Federation, the Federal Service for Intellectual Property (Rospatent), the Intellectual Property Court, the Russian Venture Company, the “Skolkovo” Foundation, the Russian State Academy of Intellectual Property (RGAIS), the Institute of State and Law of the Russian Academy of Sciences. General partners of the Forum were: Russian copyright society, “Microsoft” company, “United FDP consultants”, “Soyuzpatent Ltd.”.
The conference on the topic: "Actual issues of the turnover of intellectual property in the frames of the WTO and the Customs Union" was organized by the Chamber of Commerce and Industry of the Russian Federation and the international partner network of legal companies "Customs & Corporate Lawyers".
His speech the Partner of the law office "DS LAW" Alexander Filimonov built on the problems arising from the fulfillment of Russia's obligations after its accession to the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS). In particular, he drew attention of the public to the meeting on the application of WTO agreements, including TRIPS in Russian courts and the EurAsEC court, obtaining a franchise from foreign franchise owners.
To discuss a part of his speech dedicated to the franchise, the patent attorney of the Republic of Belarus Vyacheslav Trofimov joined in, telling that the main object of intellectual property in the contract of a complex entrepreneurial license (franchising) in the Republic of Belarus around which the "basic IPO + rights complex" is a company name, but not a trademark. At the same time, the Belarusian attorney disclosed this rule with the example of the Russian rights holder, the tour operator of “Hot Tours LLC”, who decided to register a franchise agreement with the Belarusian franchise user in the NCIS, which, in order to fulfill the requirements established in the Republic of Belarus, had to change its name to "Hot Tours-Minsk".
