The manufacturer of fiberglass alkali-resistant mesh SSH-160(100) asked whether it is possible to register as a trademark the above designation, which is an abbreviation of the name of the product. The weight of the mesh is 160 g/m2, width – 100 cm.
The answer was based on the provisions of Art. 4 of the Law on Trademarks and Service Marks. According to the mentioned article it is not allowed to register as trademarks designations that have no signs of distinction, as well as dominating signs and (or) indications, which are used to designate the type, quality, quantity, property, purpose, value of goods, as well as the time, place and method of their production or sale.
The mentioned designation (abbreviation + numerical elements) is a description of the type and properties of the manufactured product, indicating the weight and size of the mesh, and the letter part “SSH” does not have a verbal character and can be perceived by the examination as a designation that has no signs of distinction.
To give a designation distinctiveness it should be applied for registration as a trademark in a distinctive font style and in combination with graphic elements. It is possible to use a color background, special arrangement of numerical elements and other similar techniques.
