On May 25, 2023, the eighth session of the intellectual property consultation point for exporters concludes its work

A resident of the High Technology Park, the developer and the right holder of a document for a computer program, has a certificate of registration of the computer program with the National Center for Intellectual Property (hereinafter - NCIP). The representative of the developer asked whether the UE "Belpatentservice" of the BelCCI could issue a document that such a program was not deposited by the developer in the BelCCI.

When asked why such a document was needed, the developer company clarified that it had applied to the IART to determine whether its counterparty has acted illegally. The MART recommended to apply to the BelCCI for a document confirming the development of the computer program in the company.

 

The response was that the NCIP certificate of registration of a computer program is issued under the responsibility of the applicant and is not a document of title.

It is just a pseudo-protective document, which is a possible proof of authorship and property rights to the computer program. A similar document (certificate) on depositing a computer program can also be obtained from the UE "Belpatentservice" of the BelCCI.

At the same time, the BelCCI has a service for issuing documents of its own production, including computer programs. The developer was recommended to contact the appropriate service (Certification Management and Expert Activity) for further clarification.

At the same time, the UE "Belpatentservice" can issue a notification that the same program of the same developer is not deposited in the BelCCI.
