On April 13, the fifth intellectual property consultation session for exporters is held
A individual owner of a trademark registered in respect of goods of class 25 of ICGS "clothing, footwear, headwear" applied with the question of the possibility of including another individual who is a co-founder of their company, producing clothing under the registered trademark in the list of the right holders.
The answer didn't satisfy the applicant. According to Article 1 of the Law of the Republic of Belarus “On trademarks and service marks”, a trademark and service mark (hereinafter - trademark) is a designation that helps to distinguish goods, works and (or) services (hereinafter, unless otherwise provided - goods) of one person from similar goods of other persons. And Article 2 of the Law establishes that a trademark may be registered in the name of an organization or a individual.
Thus, it is unacceptable to include one more individual in the composition of the right holders of a trademark.
