On June 9, 2022, the regular session of the Intellectual Property Advisory Office for exporters ends

A Belarusian exporter was interested in the possibility of international registration of a trademark with the indication of the Republic of Belarus among other countries, in the name of his Maltese partner, who has a national trademark registration in Malta.

 

The answer concerned the fact that the partner of the Belarusian exporter does not have the opportunity to use the national Maltese registration to file an international application, since Malta is not a member of the Madrid Agreement Concerning the International Registration of Marks.

 

A Maltese company will have such an opportunity if it submits an application for a trademark to the European Union Intellectual Property Office, and then it is possible to apply for international registration with WIPO after passing a preliminary examination.  Since the mentioned European Regional Office (located in Alicante, Spain) is a party to the Protocol to the Madrid Agreement Concerning the International Registration of Marks, its members have the right to submit international trademark applications indicating a large number of countries, including the Republic of Belarus.
