Only after the license agreement for the use of its founder’s trademark has been registered in the prescribed manner is the company entitled to apply to the relevant permitting authority of the Minsk City Executive Committee for approval of an outdoor advertising sign displaying its founder’s trademark.

The use of trademark to distinguish the goods for which the trademark is registered is realized, inter alia, by applying the trademark when displaying exhibits at exhibitions and trade fairs held in the Republic of Belarus.

Designations that are identical or confusingly similar to trademarks registered or filed for registration in the Republic of Belarus in the name of another person and having earlier priority in respect of similar goods (services) may not be registered as trademarks.

If an agent or representative of the person who is the owner of a mark in one of the countries files an application for the registration of that mark in his own name without the owner’s authorization in one or more of such countries, the owner shall be entitled to oppose the registration or demand its cancellation or, if the law of the country so permits, the assignment of the registration in his favor, unless the agent or representative justifies his action.
